Chicago schools sued over claim that teacher's aide threw a stapler at teen with autism

The father of a 13-year-old boy diagnosed with autism is suing the Chicago Board of Education claiming a teacher's aide verbally abused and threw a stapler at his son.

According to the suit, filed Monday in Cook County Circuit Court, Robert Shaffer's son Davonte Shaffer was a student at Johnson James Weldon Elementary School, 1420 S. Albany Ave., on Nov. 26, 2008 when an unnamed teacher's aide allegedly threw a stapler at him and hit him.

Prior to the Nov. 26 incident, Davonte, a special needs student diagnosed with Autism Spectrum Disorder who was 12-years old at the time, was allegedly verbal berated and psychologically abused in class.

The three-count suit -- claiming negligence, willful and wanton conduct and intentional tort -- seeks at least $50,000 plus legal costs.

A spokeswoman from Chicago Public Schools declined comment Monday night.
