Canadian man charged with first degree murder in death of disabled brother

A 36-year-old Prescott man is charged with first-degree murder in connection with the death of his brother who was confined to a wheelchair.

Jamie Hawley, 41, died after being rushed to hospital in May 2008. A coroner's investigation determined he died of pneumonia, starvation and infected bedsores.

Ontario Provincial Police say Hawley's death was sudden, leading police to consider it suspicious.

At the time, Hawley was confined to a wheelchair due to a previous injury. He lived with his brother, who also acted as his immediate guardian.

Although police launched an investigation into his death immediately, it took almost two years to lay charges.

Police say the delay was due to the length of time it took to gather the necessary medical evidence.

Sgt. Kristine Rae told CTV Ottawa she could not discuss any problems with Hawley's care prior to his death because that evidence is before the courts.

Jerry Hawley was arrested this morning for first-degree murder. He is scheduled to appear in court for a bail hearing in Brockville this afternoon.
